- If you file a claim with the California Civil Rights Department, you have up to three years to make your claim. The CRD enforces California’s Fair Employment and Housing Act.
- If you file a claim with the Equal Employment Opportunity Commission, you have up to 300 days to file a claim in California. The EEOC enforces the Americans with Disabilities Act. While the EEOC ordinarily has a 180-day deadline, it’s extended if state or local agencies have measures in place preventing discrimination on the same basis.
Many people cross-file with both agencies, or the agencies work together via work-sharing agreements, which can preserve both state and federal claims.
You can also request a right-to-sue letter or notice from either the CRD or EEOC. If one is granted by the CRD, you’ll have a year to file a lawsuit in state court, while if the EEOC grants a right to sue, you have 90 days to file a federal lawsuit.
